Adult dependant Visa

The only Visa that is available for adult parents or grandparents is the Adult Dependent Relative Visa also recognised as the ADR route. This Visa type is therefore suited to individuals that are not eligible themselves for an investor or ancestry Visa. Typically, the ADR route is used to bring elderly foreign parents or grandparents to the UK to live out the rest of their lifetime. ADR type Visas, however, are often only granted in limited circumstances.

 

Adult Dependant Visa Definition

An Adult Dependent Relative Visa allows an individual to live in the UK indefinitely with access to public funds and the National Health Service (NHS) eventually. This type of Visa is separate from a “Parent Visa” which is used for parents with children under the age of 18 years old. An Adult Dependent Relative Visa relies on eligibility to be greater than just parenthood with a requirement of dependence on a sponsor. A sponsor therefore is the individual already residing within the UK and having settled status. The appropriateness of a sponsor to an applicant is paramount in the success of these Visa types.

 

Adult Dependant Visa Eligibility

As such, there are strict eligibility criteria in respect of Adult Dependent Relative Visa applications. Such criteria must be fulfilled for an application to be successful and allow an applicant to come and live in the UK. A sponsor therefore must be identified as:

  • British
  • Irish
  • Individual settled in the UK with either (Indefinite Leave to Remain, Settled Status else the Right of Abode)
  • Pre-Settled Status Holder
  • Refugee or Humanitarian Protection Holder

It should be noted that both skilled workers and students cannot act as sponsors. For workers or students to be considered sponsors, both will have had to obtain Indefinite Leave to Remain in the first instance. Further eligibility criteria considers what relationships are deemed suitable when making applications for an Adult Dependent Relative Visa. As such, an applicant must in fact be related to a sponsor either as:

  • A parent who is aged 18 years or over
  • Grandparent
  • Brother or Sister who is aged 18 years or over
  • Son or Daughter who is aged 18 years or over

These strict eligibility rules are in place to reduce the burden on UK taxpayers for the provision of the NHS and social care unto applicants whose needs can be met in their home country.
